Article 1: General provisions

The e-commerce website of Joseph Park BV, hereinafter referred to as “elevenaustraliastore.be”, offers its customers the possibility to purchase products from its online store.

These general terms and conditions (“Terms”) apply to every order placed by a visitor of this e-commerce website (“Customer”). When placing an order via the webshop of “elevenaustraliastore.be”, the Customer must explicitly accept these Terms, thereby agreeing to the application of these conditions, to the exclusion of all other terms. Any additional conditions of the Customer are excluded, unless explicitly accepted in advance in writing by “Boutique Brands BVBA”.

Article 2: Price

All prices listed are in EURO, always including VAT and all other taxes or charges payable by the Customer.

Price indications refer exclusively to the items as described in the text. Accompanying images are for illustrative purposes only and may contain elements not included in the price.

Article 3: Offer

Despite the fact that the online catalogue and webshop are compiled with the greatest possible care, it is still possible that the information provided is incomplete, contains material errors, or is not up to date. Obvious mistakes or errors in the offer do not bind “elevenaustraliastore.be”. “elevenaustraliastore.be” is only obliged to make reasonable efforts regarding the accuracy and completeness of the information provided. It shall in no case be liable for manifest material errors, typographical or printing errors.

If the Customer has specific questions regarding sizes, colour, availability, delivery time, or delivery method, we kindly ask the Customer to contact us in advance.

The offer is always valid while stocks last and may be modified or withdrawn at any time by “elevenaustraliastore.be”. “elevenaustraliastore.be” cannot be held liable for the unavailability of a product. If an offer has a limited validity period or is subject to conditions, this will be explicitly stated.

Article 4: Online purchases

The Customer may choose from different payment methods offered at the time of purchase.

“elevenaustraliastore.be” is entitled to refuse an order in case of a serious breach by the Customer regarding previous orders involving the Customer.

Article 5: Delivery and performance of the agreement

Items ordered through this webshop are delivered in Belgium and Luxembourg. Delivery methods are indicated at the time of purchase. Unless otherwise agreed, goods are delivered to the Customer’s delivery address within 5 days after receipt of the order.

Any visible damage and/or qualitative defect of an item or any other delivery issue must be reported immediately to “elevenaustraliastore.be”.

The risk of loss or damage transfers to the Customer as soon as the Customer (or a third party designated by the Customer, other than the carrier) physically takes possession of the goods. However, the risk already transfers upon delivery to the carrier if the carrier was appointed by the Customer and this option was not offered by “elevenaustraliastore.be”.

Article 6: Retention of title

All delivered items remain the exclusive property of “elevenaustraliastore.be” until full payment has been received.

The Customer agrees to inform third parties of this retention of title if necessary, for example in the event of seizure of unpaid goods.

Article 7: Warranty

Under Belgian law of 21 September 2004 regarding the protection of consumers in the sale of consumer goods, the consumer has legal rights. This legal warranty applies from the date of delivery to the first owner. Any commercial warranty does not affect these rights.

To invoke the warranty, the Customer must provide proof of purchase. Customers are advised to keep the original packaging.

For items purchased online and delivered to the Customer’s home, the Customer must contact “elevenaustraliastore.be” and return the item at their own expense.

Upon detection of a defect, the Customer must inform “elevenaustraliastore.be” as soon as possible. In any case, defects must be reported within 2 weeks after discovery. After this period, the right to repair or replacement expires.

The warranty does not apply to damage caused by accidents, negligence, drops, improper use, failure to follow instructions, modifications, misuse, poor maintenance, or abnormal use.

Defects appearing more than 2 months after purchase are considered not to be hidden defects unless proven otherwise by the Customer.

Article 8: Customer service

Article 9: Sanctions for non-payment

Without prejudice to other rights of “elevenaustraliastore.be”, in case of non-payment or late payment, the Customer shall automatically and without notice owe interest of 10% per year on the outstanding amount. In addition, a fixed compensation of 10% of the amount due is payable, with a minimum of 25 EUR per invoice.

“elevenaustraliastore.be” reserves the right to reclaim unpaid goods.

Article 10: Validity – non-waiver

If any provision is declared invalid or unenforceable, this shall not affect the validity of the remaining provisions.

Failure by “elevenaustraliastore.be” to enforce any right shall not be considered a waiver of that right.

Article 11: Modification of terms

These Terms are supplemented by other conditions explicitly referred to, as well as the general terms and conditions of sale of “elevenaustraliastore.be”. In case of contradiction, these Terms shall prevail.

Article 12: Evidence

The Customer accepts that electronic communications and backups may serve as evidence.

Article 13: Applicable law – disputes

Belgian law applies, excluding rules of private international law on applicable law.
